IMPORTANT — PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS WEBSITE OR PURCHASING SERVICES OR PRODUCTS.

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“Client,” “User,” “you,” or “your”) and Jami Scull Photography, LLC (“Company,” “we,” “us,” or “our”), a Texas limited liability company, governing your use of our website, services, and products.

By accessing this website, booking a photography session, or purchasing any product, you agree to be bound by these Terms.

If you do not agree, you must discontinue use of this website and our services immediately.

1. WHO WE ARE

Jami Scull Photography, LLC is a professional photography business based in Texas providing photography services and photographic products including fine art prints, greeting cards, and related artwork.

2. SERVICES PROVIDED

We offer professional photography services including but not limited to:

Portrait photography
Headshots
Boudoir photography
Family photography sessions

All sessions are subject to availability and must be booked in advance.

3. PRODUCTS SOLD

In addition to photography services, we offer physical and digital products including:

Fine art photographic prints
Wall art (canvas, metal, acrylic, paper prints)
Greeting cards
Photography-based artwork and merchandise

All products are created using original photography owned by Jami Scull Photography, LLC.

4. BOOKING, ORDERS & PAYMENT

A photography session is not confirmed until payment or deposit is received.
All product orders must be paid in full at the time of purchase unless otherwise stated.
Prices are subject to change at any time prior to booking or purchase.
Payment confirms agreement to these Terms.

5. CANCELLATION & RESCHEDULING POLICY

Session deposits and payments are non-refundable unless otherwise stated in writing.
Clients may request rescheduling with reasonable notice, subject to availability.
Late cancellations or no-shows may result in forfeiture of payments or deposits.
The Company reserves the right to reschedule due to illness, weather, emergencies, or unforeseen circumstances.

6. COPYRIGHT OWNERSHIP

All images, photographs, edited files, RAW files, artwork, and creative content produced by Jami Scull Photography, LLC are the exclusive intellectual property of the Company.

Under U.S. Copyright Law:

The photographer retains full copyright ownership at all times
No ownership rights are transferred to the client or purchaser

No rights are granted except those explicitly stated in the Usage Rights & Image Licensing section.

6A. AI, MACHINE LEARNING & DERIVATIVE WORKS RESTRICTIONS

All images, photographs, edited files, RAW files, artwork, and creative content produced by Jami Scull Photography, LLC are protected under U.S. Copyright Law.

Without explicit written permission from Jami Scull Photography, LLC, clients and third parties are strictly prohibited from:

Using images to train artificial intelligence (AI) systems, machine learning models, or datasets
Uploading, feeding, or inputting images into AI tools for generation, training, or enhancement purposes
Creating derivative works using artificial intelligence, including but not limited to AI-generated edits, recreations, or reinterpretations of images
Using images in AI video generation, deepfake creation, or synthetic media production
Using AI tools (including but not limited to image generators, video generators, or enhancement systems) to alter the identity, style, or likeness of the original work

This includes tools such as AI image generators, video generators, and any current or future technology that replicates, transforms, or synthesizes photographic works.

Any unauthorized use of images in connection with artificial intelligence or machine learning constitutes copyright infringement.

7. USAGE RIGHTS & IMAGE LICENSING

Clients and purchasers are granted a usage license based on the type of session or product purchased, unless otherwise agreed in writing.

Portrait, Boudoir, and Family Sessions

Clients receive a personal-use license only, which allows:

Personal printing
Personal social media sharing
Non-commercial use only

This license does not permit commercial use.

Headshots & Branding Sessions

For headshot and personal branding sessions, clients are granted a limited commercial-use license, which allows:

Use of images for business websites
Social media marketing and business profiles
Professional branding and promotional materials

This license does NOT include:

Resale or redistribution of images
Transfer of copyright ownership
Use of images in products for resale
Editing or alteration that misrepresents the photographer’s work

All copyrights remain with Jami Scull Photography, LLC unless otherwise agreed in writing.

Commercial use is limited to the client’s own professional branding and business promotion and may not be transferred, sublicensed, or resold to third parties.

General Restrictions (All Sessions)

Clients may not:

Claim authorship of images
Sell or license images to third parties
Submit images to stock photography sites
Alter final delivered images without permission

8. PRINTS, GREETING CARDS & PHYSICAL PRODUCTS

All physical products (including prints, greeting cards, and artwork) are custom-produced and considered final sale.

No returns or exchanges are accepted due to the custom nature of products
If a product arrives damaged, we will review and replace or resolve the issue on a case-by-case basis
Minor color variations may occur due to printing processes and are considered normal

Print fulfillment is handled through professional third-party labs, and minor variations in color, tone, and texture are considered normal and not defects.

9. SHIPPING & DELIVERY

Shipping times are estimates and not guaranteed
We are not responsible for delays caused by third-party carriers
Risk of loss transfers to the purchaser once items are shipped
Digital products are delivered electronically

10. ARTISTIC STYLE & CREATIVE CONTROL

All photography, editing, and artistic direction are subject to the professional judgment of Jami Scull Photography, LLC.

We do not guarantee:

Specific poses or expressions
Exact lighting conditions
Exact reproduction of sample images

Each session is a unique artistic creation.

Client expectations are managed through the photographer’s creative direction, and final image selection and editing decisions remain at the sole discretion of Jami Scull Photography, LLC.

11. NO WARRANTIES

All services, images, and products are provided “as is” without warranties of any kind, express or implied.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by Texas law, Jami Scull Photography, LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, website, images, or products.

If liability is established, it shall be limited to the amount paid for the specific service or product purchased.

13. WEBSITE CONTENT & INTELLECTUAL PROPERTY

All content on this website—including images, text, branding, logos, and design—is the property of Jami Scull Photography, LLC and is protected under U.S. copyright law.

No content may be copied, reproduced, distributed, or used without written permission.

14. PRIVACY POLICY

Your use of this website is also governed by our Privacy Policy, which explains how your information is collected and used.

Tracking & Analytics Acknowledgment
You acknowledge that our website may use third-party tracking technologies, including Google Analytics and Meta (Facebook) Pixel, as described in our Privacy Policy. By using this website, you consent to such tracking practices.

15. GOVERNING LAW

These Terms are governed by the laws of the State of Texas. Any disputes shall be handled exclusively in the courts located within Texas.
